Acquisitions & Artistic Collaborations
1. PREAMBLE
Art Atelier (hereinafter referred to as “the Atelier”) is an artistic entity operated by Mareine LLC, domiciled in Abidjan-Cocody, Côte d’Ivoire under official commercial registry number CI-ABJ-03-2022-B13-11891. The Atelier designs, creates, and sells unique and limited-edition artworks, as well as custom-made commissions. It also collaborates with artists and designers who share a vision of excellence and innovation.
2. ARTWORK ACQUISITION TERMS
2.1 Acquisition Process
Artwork acquisition follows a bidding system starting from a fixed amount including VAT. Clients submit an acquisition offer, which is evaluated by the Atelier. Once an offer is accepted:
- Transaction and shipping fees may add up.
- The client has 5 calendar days to complete the full payment.
- If payment is not made within this period, the offer acceptance becomes void, and the artwork is relisted for acquisition.
- If other offers were rejected due to the acceptance of an unserious client’s offer, the Atelier reserves the right to charge the client a compensatory fee for lost opportunities.
- The Atelier may request a banking imprint or a deposit to guarantee the client’s commitment.
- Any person submitting a custom order request or acquisition offer agrees to complete the transaction if the offer is accepted. Clients who withdraw will be permanently banned. Withdrawal is defined as failing to respond, breaking communication, or refusing a transaction they initiated.
2.2 Custom Orders
Custom-made commissions are initiated by the client and assessed based on the Atelier’s availability. Once accepted, the order requires:
- A non-refundable deposit of 60% of the total amount before production begins.
- The remaining balance to be paid at least 3 days before shipment.
- Personalization and framing costs are optional and quoted separately.
3. PAYMENT METHODS
- Cash payments are not accepted.
- Checks are accepted only if issued by a local bank.
- Visa and Mastercard credit and debit cards are accepted.
- Bank transfers are accepted.
- Payments via Mobile Money (Moov Money, Orange Money, MTN Momo) and wallets (PayPal, Wave) are accepted.
- Banking Imprint: The Atelier may require a banking imprint as a guarantee of commitment before validating an offer or a custom order.
4. DELIVERY & ASSOCIATED FEES
- Worldwide delivery is provided, at the client’s expense.
- Any customs duties and import taxes are the sole responsibility of the acquirer.
- Clients may choose a carrier recommended by the Atelier or opt for their own logistics service.
- Secure and appropriate packaging is provided to ensure the integrity of the artwork during transport.
5. OFFICIAL DOCUMENTATION PROVIDED
Each artwork is delivered with:
- A certificate of authenticity signed by the artist.
- A certificate of ownership.
- A technical sheet detailing materials, techniques, and dimensions.
- Care and maintenance instructions.
- An ownership transfer document specifying the terms of ownership and resale.
6. INTELLECTUAL PROPERTY RIGHTS & RESALE
- The artist retains all intellectual property rights over the sold artwork.
- Copying, reproducing, or modifying the artwork without written consent from the Atelier is strictly prohibited.
- The resale of the artwork by the acquirer must respect the artist resale rights, in accordance with applicable regulations.
- Any resale to a third party must be reported to the Atelier to ensure ownership documents are updated and the artwork’s authenticity is maintained.
7. ARTWORK CARE & PRESERVATION
- Artworks must be kept in a stable environment, with a temperature between 18 and 22°C and a humidity level between 40 and 60%, away from direct sunlight and abrupt climatic variations.
- The use of chemicals, abrasives, or any agents that may alter the integrity of the artwork is strictly prohibited.
- The Atelier does not provide restoration services. For any interventions on an artwork, the client must consult a qualified restoration expert.
8. CANCELLATION & REFUND POLICY
No cancellations are allowed after an offer is accepted or a custom order is confirmed.
No returns or refunds will be accepted once payment is made.
Commissioned work is allowed 2 revisions or modifications free of charge provided they do not concern core elements of the art piece (material, original design, key details etc). Modifications feasibility is evaluated on a case to case basis.
9. ARTISTIC COLLABORATIONS
The Atelier welcomes collaborations with artists who align with its vision. Any partnership proposal must meet the following criteria:
- Artworks must be original and limited edition.
- They must not be part of an industrial production.
- They must have a commercial value of at least €2,000.
- The artist must provide a portfolio showcasing artistic expertise and an aesthetic in harmony with the Atelier’s standards.
- The ability to produce exceptional works that meet the Atelier’s standards of refinement, uniqueness, and technical excellence.
- A meticulous selection of materials and mastery of artistic techniques.
- The artist must sign a collaboration contract covering: rights of exploitation, revenue sharing terms, communication and promotion guidelines and duration and conditions of the collaboration.
10. JURISDICTION & DISPUTES
Any dispute relating to these general terms will be subject to the competent courts of Côte d’Ivoire.
These conditions ensure a smooth and transparent transaction framework, tailored to an exclusive clientele seeking rare artworks and bespoke service.
