1. PR\u00c9AMBULE<\/b><\/h4>

L\u2019Atelier d\u2019Art (ci-apr\u00e8s \u00ab l\u2019Atelier \u00bb) est une entit\u00e9 artistique op\u00e9r\u00e9e par Mareine SARL, domicili\u00e9e \u00e0 Abidjan-Cocody, C\u00f4te d\u2019Ivoire sous le numero RCCM CI-ABJ-03-2022-B13-11891. L\u2019Atelier con\u00e7oit, r\u00e9alise et facilite l'acquisition des \u0153uvres d\u2019art uniques et en \u00e9dition limit\u00e9e, ainsi que des commandes personnalis\u00e9es. Il collabore \u00e9galement avec des artistes et designers partageant une vision d\u2019excellence et d\u2019innovation.<\/p>

2. MODALIT\u00c9S D\u2019ACQUISITION DES \u0152UVRES<\/b><\/h4>
2.1 Processus d\u2019Acquisition<\/b><\/h5>

L\u2019acquisition d\u2019une \u0153uvre s\u2019effectue via un syst\u00e8me d\u2019offre \u00e0 partir d\u2019un montant fix\u00e9. Les clients soumettent une proposition d\u2019acquisition, qui est \u00e9valu\u00e9e par l\u2019Atelier. Une fois l\u2019offre accept\u00e9e :<\/p>

  • Des frais de transaction et d'exp\u00e9dition peuvent s'ajouter.<\/li>
  • Le client dispose de 5 jours calendaires<\/b> pour effectuer le paiement int\u00e9gral.<\/li>
  • En cas de non-paiement dans ce d\u00e9lai, l\u2019acceptation de l\u2019offre devient caduque. L\u2019\u0153uvre est dans ce cas d\u00e9bloqu\u00e9e et re-ouverte \u00e0 l'acquisition.<\/li>
  • Si d\u2019autres offres ont \u00e9t\u00e9 refus\u00e9es en raison de cette acceptation, l\u2019Atelier se r\u00e9serve le droit de facturer au client une indemnit\u00e9 compensatoire pour la perte d\u2019opportunit\u00e9.<\/li>
  • L\u2019Atelier peut demander une empreinte bancaire ou un acompte pour garantir la bonne foi de l\u2019acqu\u00e9reur.<\/li>
  • Toute personne qui envoie une demande personnalis\u00e9e ou une offre d\u2019acquisition s\u2019engage \u00e0 aller au bout de la transaction si l\u2019offre est accept\u00e9e. Les clients qui se d\u00e9sistent seront d\u00e9finitivement bannis. D\u00e9sister signifiant ici : ne plus donner signe de vie, rompre la communication ou refuser une transaction qu\u2019ils ont eux-m\u00eames initi\u00e9e.<\/li><\/ul>

    Commande Sur - mesure<\/b><\/h5>

    Les commandes sur mesure sont initi\u00e9es par le client et \u00e9tudi\u00e9es en fonction des disponibilit\u00e9s de l\u2019Atelier. Une fois accept\u00e9e, la commande requiert :<\/p>

    • Une acompte non remboursable de 60%<\/b> du montant total avant le d\u00e9but de la production.<\/li>
    • Le solde restant \u00e0 r\u00e9gler au plus tard 3 jours avant l\u2019exp\u00e9dition.<\/b>.<\/li>
    • Les frais de personnalisation et d\u2019encadrement \u00e9tant optionnels, ils font l\u2019objet d\u2019un devis s\u00e9par\u00e9.<\/li><\/ul>

      3. MOYENS DE PAIEMENT<\/b><\/h4>
      • Aucun paiement en esp\u00e8ces n'est accept\u00e9.<\/li>
      • Les ch\u00e8ques sont accept\u00e9s uniquement s\u2019ils sont \u00e9mis par une banque locale.<\/li>
      • Les cartes bancaires Visa et Mastercard<\/strong> (credit et debit) sont accept\u00e9es.<\/li>
      • Les virements bancaires<\/strong> sont accept\u00e9s.<\/li>
      • Les paiements via Mobile Money (Moov Money, Orange Money, MTN Momo) <\/b>et wallets (PayPal, Wave)<\/b><\/b>\u00a0sont accept\u00e9s.<\/li>
      • Empreinte bancaire : L\u2019Atelier peut exiger une empreinte bancaire comme garantie de s\u00e9rieux avant validation d\u2019une offre ou d\u2019une commande personnalis\u00e9e.<\/li><\/ul>

        4. LIVRAISON & FRAIS ASSOCI\u00c9S<\/b><\/h4>
        • La livraison est assur\u00e9e partout dans le monde, aux frais et \u00e0 la charge exclusive du client.<\/b>.<\/li>
        • Les \u00e9ventuels frais de douane et taxes d\u2019importation sont \u00e0 la charge de l\u2019acqu\u00e9reur.<\/li>
        • Le client peut choisir un transporteur recommand\u00e9 par l\u2019Atelier ou opter pour son propre service logistique.<\/li>
        • Un emballage s\u00e9curis\u00e9 et adapt\u00e9 \u00e0 la nature de l\u2019\u0153uvre est fourni par l'Atelier ou le transporteur afin de garantir son int\u00e9grit\u00e9 pendant le transport.<\/li><\/ul>

          5. DOCUMENTATION OFFICIELLE FOURNIE<\/b><\/h4>

          Chaque \u0153uvre est livr\u00e9e avec :<\/p>

          • Une certificat d\u2019authenticit\u00e9<\/b> sign\u00e9 par l\u2019artiste.<\/li>
          • Une attestation de propri\u00e9t\u00e9.<\/b>.<\/li>
          • Une fiche technique<\/b> d\u00e9taillant les mat\u00e9riaux, techniques et dimensions.<\/li>
          • Des instructions d\u2019entretien et de conservation.<\/b>.<\/li>
          • Un ownership<\/strong> document de cession<\/b> pr\u00e9cisant les modalit\u00e9s de d\u00e9tention et de revente de l\u2019\u0153uvre.<\/li><\/ul>

            6. DROITS DE PROPRI\u00c9T\u00c9 INTELLECTUELLE & REVENTE<\/b><\/h4>
            • L\u2019artiste conserve tous les droits de propri\u00e9t\u00e9 intellectuelle<\/b> sur l\u2019\u0153uvre vendue.<\/li>
            • Toute copie, reproduction ou modification de l'oeuvre sans l\u2019accord \u00e9crit<\/b> de l\u2019Atelier est strictement interdite.<\/li>
            • La revente de l\u2019\u0153uvre par l\u2019acqu\u00e9reur doit respecter le droit de suite,<\/b>conform\u00e9ment aux l\u00e9gislations en vigueur.<\/li>
            • Toute revente \u00e0 un tiers devra \u00eatre notifi\u00e9e \u00e0 l\u2019Atelier afin d\u2019assurer une mise \u00e0 jour des documents de cession et garantir l\u2019authenticit\u00e9 de l\u2019\u0153uvre.<\/li><\/ul>

              7. ENTRETIEN & CONSERVATION DES \u0152UVRES<\/b><\/h4>
              • Les \u0153uvres doivent \u00eatre conserv\u00e9es dans un environnement stable<\/b>, avec une temp\u00e9rature entre 18 et 22\u00b0C<\/b> et un taux d\u2019humidit\u00e9 compris entre 40 et 60%<\/b>, \u00e0 l\u2019abri de la lumi\u00e8re directe du soleil et des variations climatiques brusques.<\/li>
              • Il est interdit d\u2019utiliser des produits chimiques, abrasifs ou tout agent pouvant alt\u00e9rer l\u2019int\u00e9grit\u00e9 de l\u2019\u0153uvre.<\/li>
              • L'Atelier ne propose pas de service de restauration<\/b>. Pour toute intervention sur une \u0153uvre, le client devra faire appel \u00e0 un expert en restauration qualifi\u00e9.<\/li><\/ul>

                8. POLITIQUE D\u2019ANNULATION & REMBOURSEMENT<\/b><\/h4>

                Aucune annulation ou modification n\u2019est possible apr\u00e8s acceptation d\u2019une offre ou validation d\u2019une commande personnalis\u00e9e.<\/p>

                Aucun retour ou remboursement n\u2019est accept\u00e9 apr\u00e8s paiement.<\/p>

                Les \u0153uvres en commande sur-mesure b\u00e9n\u00e9ficient de deux (02) r\u00e9visions ou modifications sans frais additionnels, \u00e0 condition qu\u2019elles ne portent pas sur les \u00e9l\u00e9ments fondamentaux de l\u2019\u0153uvre (mat\u00e9riau, design original, d\u00e9tails cl\u00e9s, etc.). La faisabilit\u00e9 des modifications est \u00e9valu\u00e9e au cas par cas.<\/p>

                9. COLLABORATIONS ARTISTIQUES<\/b><\/h4>

                L\u2019Atelier accueille des collaborations avec des artistes partageant sa vision. Toute proposition de partenariat doit r\u00e9pondre aux crit\u00e8res suivants :<\/p>

                • Les \u0153uvres doivent \u00eatre originales<\/b> et en \u00e9dition limit\u00e9e.<\/b>.<\/li>
                • Elles ne doivent pas \u00eatre issues d\u2019une production industrielle.<\/b>.<\/li>
                • Elles doivent avoir une valeur commerciale sup\u00e9rieure \u00e0 2 000 \u20ac.<\/b>.<\/li>
                • L'artiste devra fournir un portfolio d\u00e9montrant une ma\u00eetrise artistique et une esth\u00e9tique en accord avec la ligne de l\u2019Atelier.<\/li>
                • Une capacit\u00e9 \u00e0 produire des \u0153uvres d\u2019exception r\u00e9pondant aux standards de l\u2019Atelier en mati\u00e8re de raffinement, de singularit\u00e9 et d\u2019excellence technique.<\/li>
                • Une s\u00e9lection rigoureuse des mat\u00e9riaux et une parfaite ma\u00eetrise des techniques utilis\u00e9es.<\/li>
                • L\u2019artiste devra s\u2019engager en signant un contrat de collaboration<\/b> couvrant : la cession des droits d\u2019exploitation, la r\u00e9partition des revenus, les modalit\u00e9s de communication et de promotion, la dur\u00e9e et les conditions de la collaboration.<\/li><\/ul>

                  10. JURIDICTION & LITIGES<\/b><\/h4>

                  Tout litige relatif aux pr\u00e9sentes conditions g\u00e9n\u00e9rales sera soumis aux juridictions comp\u00e9tentes en C\u00f4te d\u2019Ivoire.<\/p>

                  General Terms and Conditions Acquisitions & Artistic Collaborations 1. PREAMBLE Art Atelier (hereinafter referred to as “the Atelier”) is an artistic entity operated by Mareine LLC, domiciled in Abidjan-Cocody, C\u00f4te d\u2019Ivoire under official commercial registry number CI-ABJ-03-2022-B13-11891. The Atelier designs, creates, and sells unique and limited-edition artworks, as well as custom-made commissions. It also collaborates with artists and designers who share a vision of excellence and innovation. \u00a0 2. ARTWORK ACQUISITION TERMS 2.1 Acquisition Process Artwork acquisition follows a bidding system starting from a fixed amount including VAT. Clients submit an acquisition offer, which is evaluated by the Atelier. Once an offer is accepted: Transaction and shipping fees may add up. The client has 5 calendar days to complete the full payment. If payment is not made within this period, the offer acceptance becomes void, and the artwork is relisted for acquisition. If other offers were rejected due to the acceptance of an unserious client’s offer, the Atelier reserves the right to charge the client a compensatory fee for lost opportunities. The Atelier may request a banking imprint or a deposit to guarantee the client’s commitment. Any person submitting a custom order request or acquisition offer agrees to complete the transaction if the offer is accepted. Clients who withdraw will be permanently banned. Withdrawal is defined as failing to respond, breaking communication, or refusing a transaction they initiated. \u00a0 2.2 Custom Orders Custom-made commissions are initiated by the client and assessed based on the Atelier\u2019s availability. Once accepted, the order requires: A non-refundable deposit of 60% of the total amount before production begins. The remaining balance to be paid at least 3 days before shipment. Personalization and framing costs are optional and quoted separately. \u00a0 3. PAYMENT METHODS Cash payments are not accepted. Checks are accepted only if issued by a local bank. Visa and Mastercard credit and debit cards are accepted. Bank transfers are accepted. Payments via Mobile Money (Moov Money, Orange Money, MTN Momo) and wallets (PayPal, Wave)\u00a0are accepted. OFFICIAL DOCUMENTATION PROVIDED Each artwork is delivered with: A certificate of authenticity signed by the artist. A certificate of ownership. A technical sheet detailing materials, techniques, and dimensions. Care and maintenance instructions. An ownership transfer document specifying the terms of ownership and resale. \u00a0 6. INTELLECTUAL PROPERTY RIGHTS & RESALE The artist retains all intellectual property rights over the sold artwork. Copying, reproducing, or modifying the artwork without written consent from the Atelier is strictly prohibited. The resale of the artwork by the acquirer must respect the artist resale rights, in accordance with applicable regulations. Any resale to a third party must be reported to the Atelier to ensure ownership documents are updated and the artwork\u2019s authenticity is maintained. \u00a0 7. ARTWORK CARE & PRESERVATION Artworks must be kept in a stable environment, with a temperature between 18 and 22\u00b0C and a humidity level between 40 and 60%, away from direct sunlight and abrupt climatic variations. The use of chemicals, abrasives, or any agents that may alter the integrity of the artwork is strictly prohibited. The Atelier does not provide restoration services. For any interventions on an artwork, the client must consult a qualified restoration expert. \u00a0 8. CANCELLATION & REFUND POLICY No cancellations are allowed after an offer is accepted or a custom order is confirmed. No returns or refunds will be accepted once payment is made. Commissioned work is allowed 2 revisions or modifications free of charge provided they do not concern core elements of the art piece (material, original design, key details etc). Modifications feasibility is evaluated on a case to case basis. \u00a0 9. ARTISTIC COLLABORATIONS The Atelier welcomes collaborations with artists who align with its vision. Any partnership proposal must meet the following criteria: Artworks must be original and limited edition. They must not be part of an industrial production. They must have a commercial value of at least \u20ac2,000. The artist must provide a portfolio showcasing artistic expertise and an aesthetic in harmony with the Atelier\u2019s standards. The ability to produce exceptional works that meet the Atelier\u2019s standards of refinement, uniqueness, and technical excellence. A meticulous selection of materials and mastery of artistic techniques. The artist must sign a collaboration contract covering: rights of exploitation, revenue sharing terms, communication and promotion guidelines and duration and conditions of the collaboration. \u00a0 10. JURISDICTION & DISPUTES Any dispute relating to these general terms will be subject to the competent courts of C\u00f4te d\u2019Ivoire.
